Wyrok w sprawie Pharrella: niebezpieczny precedens?

Jednym z najgłośniejszych wydarzeń tego tygodnia w muzycznym świecie jest ogłoszenie kontrowersyjnego wyroku w sprawie wielkiego przeboju „Blurred Lines”, autorstwa Robina Thicke i Pharrella Williamsa.
Teoretycznie to news niekoniecznie interesujący miłośników (czy producentów) muzyki tanecznej, ale tylko pozornie. Przypomnijmy bowiem, że z pozwem przeciw twórcom hitu „Blurred Lines” wystąpiła rodzina Marvina Gaye’a, autora utworu „Got To Give It Up” z 1977 roku.
Sąd uznał podobieństwo między tymi nagraniami i kazał wypłacić Pharrelowi i Robinowi prawie 7,5 miliona dolarów! Nie byłoby w tym nic dziwnego, gdyby nie fakt, że linie melodyczne tych dwóch piosenek nie mają ze sobą nic wspólnego – Thicke i Pharrell śpiewają coś zupełnie innego, niż legenda muzyki soul, a to zwykle podobieństwa między wokalami są uważane za plagiat. W przypadku „Blurred Lines” podobieństwo dotyczy samego podkładu, który rzeczywiście całkiem mocno przypomina klasyk z 1977 roku.
Tylko, że gdyby za plagiaty uważać zbliżone podkłady, można uznać, że praktycznie cała twórczość producentów muzyki house, trance, techno czy drum and bass jest jednym, wielkim plagiatem utworów, które jako pierwsze zaprezentowały takie, a nie inne rozwiązania rytmiczne i brzmieniowe.
Teoretycznie więc pionierzy tych gatunków mogą pozwać do sądu tysiące producentów, którzy do dziś z takich patentów korzystają. Czy więc przypadek wyroku dotyczącego „Blurred Lines” stanie się niebezpiecznym precedensem, który ruszy lawinę takich pozwów? Przekonamy się już niebawem, a tymczasem sprawdźcie sami porównanie dwóch omawianych tracków. One of the most famous events of this week in the music world is the announcement of the controversial judgment in the smash hit „Blurred Lines” by Robin Thicke and Pharrell Williams.
Theoretically, this news is not necessarily interesting lovers (or producers) dance music, but only superficially. Recall that, from a law suit against the creators of the hit „Blurred Lines” Marvin Gaye family occurred, the author of the song „Got To Give It Up” in 1977.
